Terms & Conditions

By booking, purchasing, or participating in any Ocean Glide service, product, course, workshop, or expedition ("the Program"), you ("the Participant", "Student", "Guest", "you" or "your") agree to the following Terms & Conditions in full.


1. AGREEMENT & OPERATOR

1.1 Business Entity Ocean Glide is a sole trader business operated by Cindy Yang, ABN [insert ABN] ("the Operator", "Ocean Glide", "we", "our" or "us").

1.2 Agreement These Terms and Conditions, together with our Privacy Policy (available at oceanglide.co/privacy), apply to your use of Ocean Glide's website and all Services (collectively, the "Agreement").

1.3 Acceptance By browsing the website, placing an order, making a booking, or participating in any Service, you agree to be bound by this Agreement. If you do not agree with the terms of the Agreement, you must not access, browse, use, book, or participate in any Ocean Glide Service.

1.4 Scope of Services These Terms & Conditions apply to all Ocean Glide offerings, both domestic (Australia-based) and international, including but not limited to:

Expeditions & Multi-Day Programs (International & Domestic):

  • International surf, freediving, and spearfishing expeditions
  • Liveaboard experiences
  • Island-based retreats and immersive programs
  • Multi-day training intensives

Local Courses & Workshops (Gold Coast & Australia):

  • Freediving courses and certification programs
  • Spearfishing skills courses
  • Surf coaching and technique workshops
  • Breathwork and BluePrint™ training sessions
  • Ocean safety and first aid courses
  • Single-day and half-day workshops
  • Beach-based training sessions
  • Pool-based skills development

Private Services (Local & Remote):

  • One-on-one coaching (surf, freediving, breath work)
  • Small group private sessions
  • Video analysis and performance consulting
  • Online coaching and programming

Products & Digital Content:

  • Ocean Glide wetsuit lube and related merchandise
  • Online courses and digital programs
  • Educational materials and training manuals

1.5 Third-Party Contractors Ocean Glide may engage independent contractors, guest facilitators, co-hosts, boat operators, accommodation providers, pool facility operators, and other third-party service providers to deliver Programs both locally and internationally.

IMPORTANT: By participating, you acknowledge and expressly agree that:

  • These third parties are not employees, agents, or representatives of Ocean Glide or Cindy Yang
  • Ocean Glide and Cindy Yang have no control over the actions of independent contractors
  • You release Ocean Glide and Cindy Yang from any and all liability arising from the actions, negligence, or omissions of such third parties
  • Your sole recourse for any issues with third-party services is against those third parties directly

1.6 Co-Hosted Programs Some Programs may be co-hosted with partner organizations (e.g., Eunoia Freediving, local operators, or international expedition providers). In such cases, the terms and conditions of all operators apply, and participants accept the terms of all listed operators. Ocean Glide and Cindy Yang are not liable for the actions of co-hosts or their employees/contractors.


2. DEFINITIONS

In this Agreement:

"Agreement" means these Terms and Conditions together with the Privacy Policy

"Course" means freediving, spearfishing, or surf courses and certification programs run by Ocean Glide

"Expedition" means multi-day international or domestic freediving, spearfishing, or surf trips

"Guest" means a person who has registered for an Expedition or Trip

"Instructor" means Ocean Glide staff or independent contractors delivering instruction

"Intellectual Property Rights" means all present and future intellectual or industrial property rights (whether registered or not) throughout the world, including patents, copyright, moral rights, trade names, trademarks, logos, systems, designs, software, domain names, trade secrets, and confidential information

"Material" means any information, data, content, text, images, audio, video, links, layout, and interfaces contained on the Ocean Glide website or published via Ocean Glide channels

"Privacy Policy" means Ocean Glide's privacy policy available at oceanglide.co/privacy

"Program" or "Service" means any Ocean Glide offering including Courses, Training, Workshops, Expeditions, Trips, coaching, or products

"Registration Data" means information provided by you for registration purposes including name, date of birth, contact details, medical history, and emergency contacts

"Student" means a person who has registered for a Course, Workshop, or Training

"Training" means freediving, spearfishing, or surf training including pool sessions, open water sessions, and beach-based skills development

"Trip" means local (Australia-based) multi-day or single-day ocean experiences

"Workshop" means single-session or short-duration skills training


3. BOOKING & CONFIRMATION

3.1 Age Requirement All Students and Guests must be 18 years of age or over unless otherwise specified for a particular Program. Ocean Glide reserves the right to request proof of age.

3.2 Booking Confirmation A booking is confirmed only when:

  • An order has been placed via the website or accepted in writing
  • The required deposit or full payment has been received by Ocean Glide
  • Payment has cleared into Ocean Glide's account
  • These Terms & Conditions have been accepted
  • Any required application or interview process has been completed (where applicable)
  • Ocean Glide has sent written confirmation (email) that the booking is confirmed

3.3 Order Acceptance An order is not legally binding on Ocean Glide until we confirm by email (to your nominated email address) that:

  • Payment has been received and cleared
  • The Services are available
  • The Order has been processed and confirmed

3.4 Participant Acknowledgement By submitting payment, you confirm and warrant that:

  • You have read, understood, and agree to these Terms in full
  • You meet the minimum participation requirements for the specific Program
  • You voluntarily accept all risks associated with ocean-based activities
  • All information provided in applications, medical forms, and registration data is true, accurate, and complete
  • You have disclosed all relevant medical conditions
  • You are physically and mentally capable of participating safely

3.5 Right to Refuse Service Ocean Glide reserves the right to refuse or cancel any booking at any time and for any reason at our sole discretion, including but not limited to:

  • Safety concerns
  • Failure to meet prerequisites
  • Inadequate skill level
  • Group dynamics concerns
  • Incomplete or inaccurate information provided
  • Failure to provide required medical clearance
  • Behavioral concerns
  • Insufficient enrollment numbers

In cases where Ocean Glide refuses or cancels a booking, a full refund of payments made will be issued.

3.6 Instructor Discretion Instructors and guides reserve the absolute right to refuse to deliver part or all of a Service to any Guest or Student at the instructor's sole discretion for safety, wellbeing, behavioral, or capability reasons. No refund will be provided in such circumstances.

3.7 Prerequisites It is the sole responsibility of all Students and Guests to ensure that required prerequisites are met before attending any Service. Failure to meet prerequisites will result in refusal of service without refund.


4. PAYMENT & PRICING

4.1 Currency All prices are listed in Australian Dollars (AUD) or United States Dollars (USD) as specified for each Program and include GST where applicable (Australian Programs only).

4.2 Pricing Changes

  • All prices displayed are subject to change without notice
  • Prices for confirmed bookings are fixed once confirmation is sent
  • Subsequent price changes will not be retroactively applied to confirmed bookings
  • Ocean Glide reserves the right to adjust pricing due to currency fluctuations, fuel surcharges, government-imposed taxes, or significant changes in operational costs
  • Participants will be notified of any price changes before final payment is due

4.3 Deposit Requirements

For International Expeditions:

  • A non-refundable deposit as specified in the Program details is required to secure your place
  • If booking is made less than 13 weeks prior to departure, full payment is required

For Local Multi-Day Programs:

  • A non-refundable deposit as specified is required
  • If booking is made less than 4 weeks prior to start date, full payment may be required

For Courses:

  • A deposit as specified is required to secure your place
  • Remaining balance due as specified in booking confirmation

For Single-Session Workshops and Training:

  • Full payment required at time of booking

4.4 Deposit Non-Refundability All deposits are strictly non-refundable under all circumstances, including but not limited to:

  • Illness, injury, or personal emergencies
  • Travel disruptions, flight cancellations, or visa issues
  • Weather events or natural disasters
  • Government restrictions or border closures
  • Personal reasons or change of plans
  • Force majeure events
  • Failure to obtain medical clearance
  • Failure to meet physical prerequisites
  • Change of mind

The deposit represents administrative, logistical, and third-party costs incurred immediately upon booking and is non-recoverable.

4.5 Balance Payment The remaining balance must be paid by the date specified in your booking confirmation:

  • International Expeditions: 13 weeks (3 months) prior to departure date unless otherwise specified
  • Local Programs: 4 weeks prior to start date unless otherwise specified
  • Courses: As specified in booking confirmation

Failure to pay the balance by the due date may result in:

  • Automatic cancellation of your booking
  • Forfeiture of all deposits paid
  • Loss of place on the Program
  • Application of late cancellation fees

4.6 Payment Methods

  • Deposits: Credit card, debit card, or bank transfer
  • Balance payments: Bank transfer only (unless otherwise specified)
  • Local workshops: Credit card, debit card, bank transfer, or cash
  • Surcharges: A surcharge may apply to credit card payments depending on the card type used

4.7 Payment Processing Payment processing services are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement"). By placing an order and using Stripe to process payments, you agree to be bound by the Stripe Services Agreement, which may be modified by Stripe from time to time. You authorize Ocean Glide to share your information and transaction information with Stripe.

4.8 Fraud Prevention

  • Ocean Glide employs fraud prevention protocols for all transactions
  • If your payment triggers suspect transaction protocols, we may contact you for additional verification
  • We may rescind transactions pending verification
  • Orders not verified within 7 days will be cancelled and refunds issued
  • Ocean Glide is under no obligation to investigate the authenticity of electronic instructions
  • You agree we may treat electronic instructions as authentic

4.9 Currency Fluctuations In the event of any refund, Ocean Glide will not be responsible for currency fluctuations and will refund the original amount invoiced in the original currency.


5. CANCELLATIONS & REFUNDS

5.1 Cancellation Notification All cancellations must be submitted in writing to cindy@oceanglide.co

5.2 No Exceptions Policy Exceptions to cancellation policies cannot be made for any reason. Ocean Glide does not offer credit, refund, or compensation for:

  • Arriving late or departing early
  • Missing activities
  • Opting out of activities
  • Not utilizing any part of the Program
  • Medical issues arising after booking
  • Personal emergencies
  • Travel disruptions
  • Weather delays

5.3 Participant-Initiated Cancellations

INTERNATIONAL EXPEDITIONS:

Deposits:

  • Non-refundable under all circumstances

6+ months (26+ weeks) before departure:

  • Payments beyond deposit may be refunded
  • OR at Guest's election, applied to another Expedition within 12 months

3-6 months (13-26 weeks) before departure:

  • 50% of total payment (excluding deposit) forfeited
  • 50% may be refunded OR applied to another Expedition within 12 months at Guest's election

Less than 3 months (13 weeks) before departure:

  • 100% of total payment forfeited
  • No refund or transfer available

No-shows, late arrivals, early departures:

  • No refund or credit issued

LOCAL MULTI-DAY TRIPS (AUSTRALIA):

4+ weeks before start date:

  • Full refund less non-refundable deposit

Less than 4 weeks before start date:

  • No refund or transfer available

No-shows, late arrivals, early departures:

  • No refund or credit issued

COURSES:

7+ days before start date:

  • 100% payment refunded

0-7 days before start date:

  • $200 AUD reschedule fee applies
  • No refund available

During course - missed sessions or opt-outs:

  • No refund available

Failure to complete course within 12 months:

  • Student must complete course again at full price (PADI requirement for certification courses)

SINGLE-SESSION WORKSHOPS & TRAINING:

48+ hours before session:

  • 100% payment refunded or transferred

Less than 48 hours before session:

  • No refund or transfer available

No-shows or late arrivals:

  • No refund available

PRIVATE GROUP BOOKINGS:

  • Treated as single booking with one point of contact (POC)
  • POC responsible for all payments and group changes
  • If group member drops out, POC must refill spot or forfeit cost
  • No refunds or discounts for reduced group size
  • Pricing based on total group size, not per-person

5.4 Medical Clearance as Cancellation If a Student or Guest indicates a past medical condition and fails to provide required doctor's clearance by the specified deadline, it will be treated as a participant-initiated cancellation at the time Ocean Glide was notified of the failure to provide clearance. Standard cancellation fees apply.

5.5 Failure to Meet Physical Prerequisites If a Student is unable to demonstrate required physical prerequisites (e.g., ability to swim 200m uninterrupted and unassisted, ability to hold breath for specified duration, ability to dive to specified depth), no refund will be granted. This constitutes a participant-initiated cancellation on the day of the Program.

5.6 Operator-Initiated Cancellations

Ocean Glide reserves the right to modify, reschedule, postpone, or cancel any Program (local or international) due to:

  • Weather or ocean conditions deemed unsafe
  • Vessel safety or mechanical issues
  • Pool or facility unavailability (local Programs)
  • Insufficient enrollment numbers
  • Medical emergencies
  • Instructor illness or unavailability
  • Government restrictions, border closures, or travel advisories
  • Force majeure events (see Section 16)
  • Failure or liquidation of third-party service providers
  • Changes to regulations or legislation

If Ocean Glide cancels a Program prior to start date, Guests/Students may elect:

  • Full refund of all payments made, excluding non-recoverable third-party costs (boat charters, accommodation deposits paid to third parties, facility hire, equipment deposits, etc.)
  • OR credit toward a future Ocean Glide Program to be used within 12 months
  • OR transfer to an alternative date (subject to availability)

If Ocean Glide postpones due to insufficient enrollment: Students/Guests may elect:

  • Full refund of payments made
  • OR transfer to alternative date within 12 months (subject to availability)

5.7 What Ocean Glide is NOT Responsible For Ocean Glide and Cindy Yang are not responsible for and will not reimburse:

  • International or domestic flights
  • Accommodation booked before, during, or after the Program
  • Travel insurance premiums
  • Visa application fees
  • Airport transfers not included in Program
  • Meals not included in Program
  • Personal travel expenses (parking, taxis, additional meals, etc.)
  • Lost wages or opportunity costs
  • Non-refundable bookings made in conjunction with the Program
  • Currency exchange fees or fluctuations
  • Expenses incurred in preparation for cancelled Services

5.8 Itinerary & Schedule Changes Ocean Glide reserves the right to make reasonable changes to:

  • Itineraries
  • Schedules
  • Locations
  • Activities
  • Dive sites
  • Accommodation (provided standards are maintained)
  • Instructors or guides
  • Dates and times

Such changes may be made due to weather, ocean conditions, safety concerns, facility availability, third-party issues, or operational needs. Reasonable changes to itineraries, schedules, locations, or activities do not constitute grounds for refund or compensation.

For local courses and workshops, if weather or conditions prevent safe ocean access, sessions may be:

  • Rescheduled to an alternative date
  • Moved to an alternative location (pool, indoor venue, etc.)
  • Modified to theory-based or land-based training
  • Combined with future sessions

Ocean Glide will use best endeavors to maintain the same standard as the original booking.


6. BOOKING REQUIREMENTS

6.1 Mandatory Documentation To book any Service, every Student or Guest must provide Ocean Glide with:

(i) Medical History Form:

  • Completed medical questionnaire
  • OR doctor's clearance if any medical conditions are indicated

(ii) Liability Waiver:

  • Signed participation and liability waiver form

(iii) Government Health Requirements:

  • Evidence of compliance with current government health orders (e.g., vaccination certificates) if required at the time of the Program

(iv) Registration Data:

  • Complete and accurate registration information including emergency contacts

(v) Travel Insurance (International Programs):

  • Proof of comprehensive travel insurance covering all Program activities

6.2 Deadline for Documentation All required documentation must be submitted:

  • International Expeditions: 4 weeks prior to departure
  • Local Programs: 1 week prior to start date
  • Courses: Before first session
  • Workshops: Before session (or notification if medical clearance required)

6.3 Failure to Provide Documentation Failure to provide required documentation by the specified deadline will result in:

  • Automatic cancellation of the booking
  • Forfeiture of all payments made (deposit and balance)
  • No refund or credit issued
  • Loss of place on the Program

This is treated as a participant-initiated cancellation.


7. EQUIPMENT

7.1 Equipment Provided by Ocean Glide Where Ocean Glide provides equipment (safety gear, snorkel gear, training equipment, etc.), Students and Guests are responsible for:

  • Using equipment correctly and as instructed
  • Inspecting equipment before use and reporting any issues immediately
  • Caring for equipment during use
  • Returning equipment in good condition at the end of the session/Program
  • Reporting damage or malfunction immediately

7.2 Equipment Damage, Loss, or Non-Return All equipment rented or supplied through Ocean Glide must be returned in good condition by the end of the session, event, or Program.

Damaged, lost, or unreturned equipment will be charged at full replacement value plus any administrative fees.

Students and Guests are liable for:

  • Negligent damage to equipment
  • Lost equipment
  • Stolen equipment (unless theft is reported to police and Ocean Glide within 24 hours)
  • Equipment not returned
  • Equipment returned in significantly worse condition than issued

Normal wear and tear is accepted. Negligent or reckless damage is not.

7.3 Personal Equipment Students and Guests are encouraged to bring their own personal equipment where appropriate (mask, fins, wetsuit, etc.). Ocean Glide is not responsible for damage, loss, or theft of personal equipment.


8. TRAVEL INSURANCE

8.1 Mandatory for International Programs Comprehensive travel insurance is MANDATORY for all international Expeditions and multi-day Programs and must include coverage for:

  • Ocean activities (surfing, freediving, spearfishing, diving, snorkeling)
  • Medical treatment and hospitalization
  • Emergency evacuation and repatriation
  • Trip cancellation and interruption
  • Lost or damaged personal belongings
  • Force majeure events

8.2 Recommended for All Programs While not mandatory for local courses and workshops, Ocean Glide strongly recommends comprehensive activity insurance covering ocean-based activities for all Programs.

8.3 Proof of Insurance

  • Proof of valid travel insurance must be provided upon request
  • For international Programs, proof must be submitted at least 4 weeks prior to departure
  • Failure to provide proof of insurance may result in cancellation without refund

8.4 Participant Responsibility It is the Participant's sole responsibility to:

  • Obtain appropriate insurance coverage
  • Ensure the policy covers all activities included in the Program
  • Understand policy terms, conditions, and exclusions
  • File claims directly with the insurance provider
  • Provide accurate information to the insurer

Ocean Glide accepts no liability for inadequate, inappropriate, or absent insurance coverage.


9. HEALTH, FITNESS & MEDICAL DISCLOSURE

9.1 Fitness Requirements By participating, you confirm and warrant that:

  • You are physically fit for ocean-based activities
  • You are mentally fit for ocean-based activities
  • You are capable of meeting the physical demands of your chosen Program
  • You have no medical conditions that would prevent safe participation
  • You are not under the influence of drugs or alcohol
  • You have honestly and completely disclosed all relevant medical information

9.2 Mandatory Medical Disclosure You must disclose all relevant medical conditions, medications, allergies, and health concerns on the required medical questionnaire or verbally to instructors. This includes but is not limited to:

  • Cardiovascular or heart conditions
  • Respiratory issues (asthma, COPD, etc.)
  • Ear, sinus, or lung problems or surgeries
  • Neurological conditions or seizure disorders
  • Diabetes or blood sugar issues
  • Pregnancy or possibility of pregnancy
  • Psychological or psychiatric conditions
  • Any condition affecting judgment, consciousness, or physical capability
  • Current medications
  • Recent surgeries or injuries
  • Allergies (including to marine life)

9.3 Consequences of Non-Disclosure Failure to disclose relevant medical information may result in:

  • Immediate removal from the Program without refund
  • Voiding of all liability waivers and releases
  • Personal liability for all medical costs incurred
  • Personal liability for evacuation costs
  • Potential legal liability for endangering others
  • Ocean Glide may pursue claims for costs incurred due to non-disclosure

9.4 Medical Clearance Requirements Ocean Glide requires doctor's clearance for certain medical conditions including but not limited to:

  • Cardiovascular disease or heart conditions of any kind
  • Respiratory issues (asthma, COPD, chronic bronchitis, etc.)
  • Ear, sinus, or lung surgeries within the past 12 months
  • Seizure disorders or epilepsy
  • Pregnancy
  • Diabetes (Type 1 or Type 2)
  • Psychological conditions affecting judgment or safety
  • Any condition on PADI/SSI medical forms requiring clearance
  • Any condition that has required hospitalization in the past 12 months
  • Use of medications that affect consciousness or judgment

Doctor's clearance must:

  • Be on official letterhead
  • Be signed and dated within 3 months of Program start date
  • Specifically state fitness for freediving, scuba diving, surfing, or spearfishing (as applicable)
  • Be provided by a qualified medical practitioner

Failure to obtain or provide required medical clearance will be treated as a participant-initiated cancellation. Standard cancellation fees apply.

9.5 Pregnancy

  • Pregnant participants cannot participate in any ocean-based Programs
  • If you become pregnant after booking, you must notify Ocean Glide immediately
  • Standard cancellation terms apply
  • Travel insurance may cover this circumstance

9.6 Substance Use

  • Participation in ocean activities under the influence of alcohol or illegal drugs is strictly prohibited
  • Prescription medications that affect judgment, consciousness, or physical capability must be disclosed
  • Violations will result in immediate removal from the Program without refund
  • Ocean Glide may report illegal drug use to authorities

9.7 Changes in Health Status If your health status changes between booking and the Program start date, you must:

  • Notify Ocean Glide immediately in writing
  • Provide updated medical information
  • Obtain new medical clearance if required
  • Accept that standard cancellation terms may apply

9.8 Daily Health Declarations For multi-day Programs, participants may be required to complete daily health declarations confirming fitness to participate. False declarations may result in removal without refund.


10. OCEAN RISK ACKNOWLEDGEMENT

10.1 Inherent and Significant Risks You acknowledge, understand, and expressly agree that ocean-based activities (both local and international) involve inherent, significant, and potentially life-threatening risks, including but not limited to:

Water-Related Risks:

  • Drowning or near-drowning
  • Shallow water blackout
  • Hypoxia (oxygen deprivation)
  • Hyperventilation
  • Decompression sickness (DCS) or "the bends"
  • Nitrogen narcosis
  • Barotrauma (pressure-related injuries)
  • Ear or sinus squeeze
  • Lung squeeze or pulmonary barotrauma
  • Air embolism

Environmental Risks:

  • Strong currents, rip tides, and changing ocean conditions
  • Big wave impact and hold-downs
  • Reef contact, cuts, and lacerations from sharp coral
  • Rock contact and injury
  • Shallow water hazards
  • Boat traffic and propeller strikes
  • Extreme weather conditions
  • Lightning strikes
  • Hypothermia or hyperthermia
  • Sunburn, heatstroke, and dehydration

Marine Life Risks:

  • Sharks, rays, and other potentially dangerous marine animals
  • Jellyfish, bluebottles, and other stinging creatures
  • Sea snakes and venomous fish
  • Sea urchins and stonefish
  • Coral cuts and infections
  • Marine bacteria and infections

Equipment & Activity Risks:

  • Equipment failure or malfunction
  • Speargun injuries
  • Entanglement in lines or kelp
  • Loss of fins or mask underwater
  • Surfboard impact injuries
  • Boat-related injuries (boarding, disembarking, in-transit)

Location Risks:

  • Remote locations with limited or no medical access
  • Delayed emergency response
  • Limited or no cell phone coverage
  • Evacuation difficulties
  • Distance from hyperbaric chambers
  • Language barriers (international Programs)

Other Risks:

  • Slips, falls, and impacts
  • Pool-related injuries (for pool training)
  • Exhaustion and fatigue
  • Panic or anxiety attacks
  • Heart attack or stroke
  • Allergic reactions
  • Infections and disease
  • COVID-19 or other communicable diseases

10.2 Risk of Death or Permanent Injury You specifically acknowledge that ocean activities can result in:

  • Death
  • Permanent disability
  • Paralysis
  • Brain damage
  • Loss of limbs
  • Blindness or loss of vision
  • Hearing loss
  • Chronic pain
  • Scarring and disfigurement
  • Psychological trauma

10.3 Voluntary Assumption of All Risks You voluntarily and expressly assume ALL risks associated with participation, including those listed above and those not listed. You acknowledge that:

  • Ocean Glide, Cindy Yang, instructors, and contractors cannot guarantee your safety
  • Ocean activities are inherently dangerous
  • Accidents can occur even with proper safety procedures
  • You may be injured or killed regardless of safety measures taken
  • You are choosing to participate knowing these risks

10.4 Personal Responsibility for Safety You accept full personal responsibility for your safety and agree to:

  • Follow all safety briefings and instructions without exception
  • Make conservative decisions based on your personal skill level and comfort
  • Never exceed your personal capabilities
  • Communicate concerns, discomfort, or injuries immediately and honestly
  • Withdraw from activities if you feel unsafe or uncomfortable
  • Never participate under the influence of alcohol or drugs
  • Maintain your equipment properly
  • Stay within your certification and training limits
  • Use common sense and good judgment
  • Not rely solely on others for your safety

10.5 No Rescue Guarantee You acknowledge that:

  • Ocean Glide and its instructors will make reasonable efforts to assist in emergencies
  • However, rescue is not guaranteed
  • Conditions may prevent or delay rescue
  • Emergency services may be unavailable, delayed, or distant
  • You may be required to self-rescue
  • Other participants are not obligated to rescue you

11. SAFETY & CONDUCT

11.1 Mandatory Safety Protocols Participants must:

  • Attend all safety briefings without exception
  • Pay full attention during safety briefings
  • Follow all instructions from Ocean Glide staff and contractors immediately and completely
  • Use all provided safety equipment correctly
  • Perform required safety checks before all activities
  • Communicate any concerns, discomfort, injuries, or equipment issues immediately
  • Never exceed personal skill or comfort level
  • Buddy check and follow buddy system procedures
  • Follow facility rules (pools, beaches, vessels, accommodations, national parks, etc.)
  • Respect safety zones and boundaries
  • Report all incidents, near-misses, and safety concerns
  • Participate in emergency drills if conducted

11.2 Conduct Requirements Participants must:

  • Respect instructors, crew, guides, facilitators, and fellow participants
  • Conduct themselves responsibly on vessels, in facilities, and in the ocean
  • Respect local cultures, customs, laws, and communities
  • Follow all environmental and ethical guidelines
  • Arrive on time for all sessions and activities
  • Be prepared with required equipment and clothing
  • Participate actively and cooperatively
  • Not create unnecessary risk for themselves or others
  • Follow all lawful instructions from authorities
  • Respect quiet hours and shared spaces
  • Maintain personal hygiene appropriate for close quarters (multi-day Programs)

11.3 Prohibited Behaviors The following behaviors are strictly prohibited and will result in immediate removal from the Program without refund:

  • Unsafe behavior in or around water
  • Ignoring or refusing to follow safety instructions
  • Disruptive, aggressive, threatening, or disrespectful conduct
  • Harassment of any kind (sexual, verbal, physical)
  • Being under the influence of alcohol or drugs during activities
  • Illegal drug use at any time
  • Environmental negligence or deliberate harm to marine life
  • Theft or damage to property
  • Violating local laws or regulations
  • Reckless endangerment of self or others
  • Repeated tardiness or failure to participate
  • Creating a hostile or uncomfortable environment for others

11.4 Instructor Absolute Discretion Instructors and guides have absolute discretion to:

  • Refuse participation in any activity for any safety, behavioral, or wellbeing reason
  • End a dive or session immediately
  • Remove a participant from activities
  • Remove a participant from the entire Program
  • Modify activities based on conditions or participant capability
  • Make all final decisions regarding safety

No refund, credit, or compensation will be provided when participants are removed or refused for safety, behavioral, or wellbeing reasons.

11.5 Right to Film Refusal Ocean Glide reserves the right to refuse participation to anyone who appears in films, videos, or social media content that:

  • Promotes unsafe freediving, spearfishing, or surf practices
  • Shows disregard for marine life or environmental ethics
  • Could damage Ocean Glide's reputation
  • Contradicts Ocean Glide's values and teaching methods

12. ENVIRONMENTAL & ETHICAL RESPONSIBILITY

12.1 Environmental Commitment All participants agree to:

  • Respect marine life and reef environments at all times
  • Follow ethical wildlife interaction guidelines strictly
  • Minimize environmental impact
  • Leave no trace
  • Never touch, chase, ride, or harass marine life
  • Never feed, bait, or manipulate wildlife for encounters or photos
  • Dispose of all waste properly (pack in, pack out)
  • Use only reef-safe, biodegradable products
  • Respect protected marine areas, marine parks, and no-take zones
  • Follow all environmental regulations and laws
  • Report environmental damage or violations
  • Participate in conservation activities when included in Programs

12.2 Ethical Wildlife Interactions

  • Wildlife encounters are a privilege, not a right
  • All interactions must be on the animals' terms
  • Maintain appropriate distances as instructed
  • Approach slowly and calmly if approach is permitted
  • Leave immediately if animals show signs of stress or discomfort
  • Never block escape routes or surround animals
  • Never separate mothers from young
  • Quality of encounter matters more than photos or videos
  • Instructors may end encounters at any time if animal welfare is compromised

12.3 Ethical Hunting (Spearfishing Programs) For spearfishing Programs, participants agree to:

  • Practice selective, sustainable hunting only
  • Take only what will be consumed
  • Make clean, humane shots
  • Follow size and bag limits strictly
  • Avoid protected, endangered, or threatened species
  • Respect spawning aggregations and nursery areas
  • Share catches fairly
  • Use all parts of the fish taken
  • Properly handle and store catches
  • Follow local fishing regulations and customs
  • Report all catches honestly

12.4 Zero Tolerance Policy Ocean Glide has zero tolerance for:

  • Deliberate harm to marine life
  • Taking protected species
  • Exceeding bag limits
  • Unethical hunting practices
  • Environmental damage
  • Littering or pollution
  • Violation of marine protected areas

Violations will result in immediate removal from the Program without refund and may be reported to authorities.

12.5 Photography Ethics

  • Animal welfare always takes priority over photos
  • Never harass animals for better photos
  • Do not use flashes on animals at night without instructor permission
  • Share photo locations responsibly to avoid site damage
  • Respect requests not to share specific locations publicly

13. LIABILITY WAIVER & RELEASE

13.1 Complete Release of Liability To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue:

  • Ocean Glide (the business)
  • Cindy Yang (personally and in her capacity as sole trader)
  • All independent contractors, co-hosts, facilitators, and instructors (and their employees)
  • Boat operators, captains, crew, and vessel owners
  • Accommodation providers and their staff
  • Pool and facility operators and their staff
  • Equipment manufacturers and suppliers
  • Partner organizations and co-hosts
  • Any and all third-party service providers
  • All officers, agents, employees, volunteers, and representatives of the above

(collectively, the "Released Parties")

from any and all liability, claims, demands, actions, causes of action, damages, losses, costs, and expenses (including legal fees) for any injury, illness, death, loss, damage, or expense of any kind arising from your participation in any Ocean Glide Program.

13.2 Scope of Release - Includes Negligence This release applies to claims arising from:

  • The negligence of Ocean Glide, Cindy Yang, contractors, or third parties (to the fullest extent permitted by law)
  • The negligence of other participants
  • Equipment failure, malfunction, or defects
  • Inherent risks of ocean activities
  • Medical emergencies, delayed medical care, or lack of medical facilities
  • Acts of nature or force majeure events
  • Facility-related injuries (pools, beaches, boats, accommodations)
  • Transportation to/from locations
  • Food-related illness or allergic reactions
  • Criminal acts of third parties
  • Any other cause related to participation in the Program, whether or not the cause is known or should have been known

13.3 Broad Interpretation This release is intended to be as broad and inclusive as permitted by law. If any portion is held invalid, the remainder shall continue in full legal force and effect.

13.4 Binding on Heirs and Estate You acknowledge that this release is binding on your heirs, next of kin, executors, administrators, assigns, and legal representatives.

13.5 Independent Claims You agree that you will not make a claim or file a lawsuit against any Released Party for any injury, death, or damage arising from your participation, even if caused in whole or in part by negligence of the Released Parties.

13.6 Waiver of Rights You expressly waive any and all rights under any statute or law that would limit the scope of this release, including but not limited to Section 5 of the Civil Liability Act 2002 (NSW) or similar legislation in other Australian states and territories.


14. INDEMNIFICATION

14.1 Your Agreement to Indemnify You agree to indemnify, defend, and hold harmless Ocean Glide, Cindy Yang, and all Released Parties from any and all claims, damages, losses, liabilities, and expenses (including reasonable legal fees and costs) arising from or related to:

  • Your actions, negligence, recklessness, or misconduct
  • Your breach of these Terms & Conditions
  • Your violation of any laws or regulations
  • Any injury or damage you cause to other participants, third parties, or property
  • Any misrepresentation or failure to disclose medical information
  • Claims brought by your family, heirs, estate, or legal representatives
  • Your use of alcohol or drugs
  • Your failure to follow instructions
  • Rescue or medical costs incurred on your behalf
  • Evacuation costs
  • Equipment damage or loss caused by your negligence

14.2 Defense Obligations You agree to cooperate fully in the defense of any claim and to pay all costs, including reasonable attorney's fees.

14.3 Survival This indemnification survives the termination of your participation in any Program and continues indefinitely.


15. MAXIMUM LIABILITY CAP

15.1 Aggregate Liability Limit Without limiting the generality of the liability release and indemnification provisions, you acknowledge and agree that Ocean Glide's and Cindy Yang's maximum aggregate liability to you for any and all claims arising from or related to your participation in any Program shall not exceed AUD $100,000.00 (one hundred thousand Australian dollars).

15.2 Fair Allocation of Risk You acknowledge and agree that the limitations of liability contained in this Agreement are a fair and reasonable allocation of commercial and legal risk between the parties, given:

  • The inherently dangerous nature of ocean activities
  • The sole trader structure of the business
  • The pricing of Programs
  • Your voluntary assumption of risk
  • The availability of personal insurance to you

15.3 No Liability for Certain Damages To the maximum extent permitted by law, Ocean Glide and Cindy Yang exclude all liability for:

  • Special, indirect, or consequential loss or damage
  • Loss of income, revenue, business, profits, contracts, or anticipated savings
  • Loss of data or loss of privacy
  • Loss of goodwill or reputation
  • Any damages exceeding the liability cap in clause 15.1

16. FORCE MAJEURE

16.1 Force Majeure Events Ocean Glide and Cindy Yang will not be liable for failure to perform obligations under this Agreement due to events beyond reasonable control (force majeure), including but not limited to:

  • Natural disasters (earthquakes, cyclones, hurricanes, tsunamis, floods, bushfires, volcanic activity, etc.)
  • Pandemics, epidemics, or public health emergencies
  • Government actions, border closures, lockdowns, or travel restrictions
  • War, invasion, action of foreign enemies, or terrorism
  • Civil unrest, riots, or strikes
  • Vessel or critical equipment failures
  • Closure of airports, ports, or borders
  • Fuel shortages or supply chain disruptions
  • Failure or insolvency of third-party service providers
  • Changes in regulations or legislation affecting the Program
  • Cyber attacks or technology failures

16.2 Obligations During Force Majeure In the event of force majeure, Ocean Glide will:

  • Make reasonable efforts to notify participants as soon as practicable
  • Make reasonable efforts to reschedule or provide alternative arrangements
  • Provide refunds as outlined in Section 5.6 (excluding non-recoverable third-party costs)

Ocean Glide is not obligated to provide refunds, credits, or compensation beyond those specified in Section 5.6.

16.3 No Liability for Consequential Losses Ocean Glide and Cindy Yang are not liable for any consequential losses, expenses, or damages arising from force majeure events, including but not limited to flight costs, accommodation costs, lost wages, or opportunity costs.


17. PERSONAL BELONGINGS & EQUIPMENT

17.1 Personal Responsibility Ocean Glide and Cindy Yang are not responsible for loss, theft, damage, or destruction of:

  • Personal belongings (luggage, clothing, electronics, jewelry, watches, cameras, etc.)
  • Surf equipment, dive gear, fins, masks, wetsuits, or other sporting equipment
  • Cash, credit cards, wallets, or other valuables
  • Travel documents (passport, visas, tickets, etc.)
  • Vehicles or items left in vehicles during Programs
  • Medication or medical devices
  • Food or dietary items
  • Any other personal property

17.2 Secure Storage Ocean Glide will make reasonable efforts to provide secure storage for personal belongings during sessions and on multi-day Programs, but accepts no liability for theft, loss, or damage.

Participants are strongly advised to:

  • Leave unnecessary valuables at home
  • Use waterproof cases for electronics
  • Label all personal equipment
  • Keep valuables in secure accommodation
  • Obtain appropriate insurance for valuable items

17.3 Vehicle Security Items left in vehicles during Programs (including locked vehicles) are left entirely at the participant's risk. Ocean Glide and Cindy Yang have no responsibility for theft from or damage to vehicles.


18. PHOTOGRAPHY & MEDIA RELEASE

18.1 Permission to Capture Media Ocean Glide, its staff, contractors, and designated photographers may capture photographs, video footage, audio recordings, and other media during Programs.

18.2 Grant of Rights By participating in any Program, you grant Ocean Glide a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce, modify, publish, distribute, and display such media for:

  • Promotional and marketing purposes (website, social media, brochures, advertisements, etc.)
  • Educational content and training materials
  • Print and digital publications
  • Portfolio and showcase purposes
  • Any other business purpose

18.3 No Compensation You acknowledge that you will receive no compensation, payment, or royalties for the use of your image, likeness, voice, or media featuring you.

18.4 Opt-Out Procedure You may opt out of media use by providing written notice to Ocean Glide:

  • Prior to the Program start date (International: 4 weeks prior; Local: 1 week prior)
  • Via email to cindy@oceanglide.co
  • Clearly stating your name, booking reference, and opt-out request

Important:

  • Opt-out does NOT apply to group photos where you are incidentally included
  • Opt-out does NOT apply to photos/videos taken for safety documentation
  • Opt-out must be requested before the Program begins
  • Last-minute opt-out requests may not be honored
  • If you appear in media captured by other participants, Ocean Glide has no control over their use

18.5 Participant Photography Participants are welcome to take personal photos and videos during Programs for personal use only, subject to:

  • Not interfering with Program activities
  • Respecting other participants' privacy
  • Following ethical wildlife photography guidelines
  • Not selling or commercially exploiting images without Ocean Glide's written permission
  • Not tagging specific locations of sensitive wildlife sites without permission

19. INTELLECTUAL PROPERTY

19.1 Ocean Glide Ownership Ocean Glide and Cindy Yang are the sole and exclusive owners of all Intellectual Property Rights in:

  • The Ocean Glide website and all content therein
  • All Materials published by Ocean Glide
  • BluePrint™ methodology and framework
  • Training systems and curricula
  • Educational materials, manuals, and handouts
  • Videos, audio recordings, and digital content
  • Logos, trademarks, and branding
  • Proprietary techniques and methods
  • Course structures and progressions

19.2 Limited License You are granted a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use educational materials provided during your Program
  • Use such materials for personal, non-commercial purposes only
  • Retain handouts and materials for personal reference

19.3 Prohibited Uses You may NOT:

  • Reproduce, distribute, sell, or commercially exploit Ocean Glide materials
  • Use Ocean Glide methodologies for commercial purposes (including teaching others)
  • Record or distribute Program content (video, audio, written) without written permission
  • Claim ownership of Ocean Glide intellectual property
  • Teach or resell Ocean Glide methodologies without formal certification and written licensing agreement
  • Modify or create derivative works from Ocean Glide materials
  • Remove copyright or trademark notices from materials
  • Use Ocean Glide trademarks or branding without written permission

19.4 Enforcement Unauthorized use of Ocean Glide's intellectual property may result in:

  • Legal action for copyright/trademark infringement
  • Injunctive relief
  • Claims for damages
  • Termination of access to future Programs
  • Criminal prosecution where applicable

20. PRIVACY & DATA PROTECTION

20.1 Information Collection Ocean Glide collects and processes personal information including:

  • Contact details (name, email, phone, address, date of birth)
  • Medical and health information
  • Emergency contact information
  • Payment information
  • Photographs and videos
  • Booking and participation history
  • Correspondence and communications

20.2 Use of Information Your information is used for:

  • Program administration and communication
  • Safety and medical purposes (including sharing with emergency services if necessary)
  • Improving Ocean Glide services
  • Marketing communications (with consent)
  • Legal compliance
  • Statistical analysis

20.3 Data Security Ocean Glide takes reasonable measures to protect your personal information through:

  • Secure storage systems
  • Limited access protocols
  • Regular security reviews

However, Ocean Glide cannot guarantee absolute security of data transmitted over the internet or stored electronically.

20.4 Third-Party Sharing Your information may be shared with:

  • Independent contractors and service providers (boat operators, accommodation providers, co-hosts, instructors)
  • Payment processors (Stripe)
  • Medical professionals in case of emergency
  • Emergency services if required
  • Authorities if required by law
  • Insurance providers (with your consent)

20.6 Consent By booking or participating in any Program, you consent to the collection, use, and disclosure of your personal information as described in this Agreement and the Privacy Policy.


21. MINORS (UNDER 18 YEARS)

21.1 Parental/Guardian Consent Required Participants under 18 years of age ("Minors") may only participate if:

  • A parent or legal guardian signs these Terms & Conditions on their behalf
  • A parent or legal guardian completes and signs all medical and consent forms
  • A parent or legal guardian provides written authorization for medical treatment
  • Specific age requirements for the Program are met

21.2 Supervision Requirements

For Local Programs:

  • A parent or legal guardian must remain on-site during all sessions unless alternative supervision arrangements are approved in writing by Ocean Glide

For International Programs:

  • Minors must be accompanied by a parent or legal guardian who is also enrolled in the Program
  • Alternative supervision arrangements must be approved in writing by Ocean Glide at least 4 weeks prior to departure
  • Unaccompanied minors will not be accepted

21.3 Parent/Guardian Liability The parent or legal guardian assumes all liability and responsibility for the Minor's participation and agrees to the terms of the liability waiver and indemnification on behalf of the Minor.


22. PROMOTIONS, GIFT VOUCHERS & DISCOUNTS

22.1 Gift Voucher Validity

  • Gift vouchers are valid for 36 months from date of purchase
  • Services must be booked within the 36-month validity period
  • Services may be completed after the 36-month period if booked before expiry
  • Expired vouchers have no value and will not be honored
  • No extensions will be granted

22.2 Package Offers

  • Package offers must be clearly indicated at time of purchase
  • All services in the package must be booked within 36 months of purchase
  • Services not booked within 36 months will no longer be valid
  • Packages cannot be split between multiple people unless specified
  • No refunds for unused portions of packages

22.3 Promotional Discount Codes

  • Promotional codes may be offered at Ocean Glide's sole discretion
  • Terms and conditions specific to each promotion will be provided
  • Codes may have expiry dates, usage limits, or other restrictions
  • Codes cannot be combined unless explicitly stated
  • Codes cannot be applied retroactively to confirmed bookings
  • Ocean Glide reserves the right to cancel or modify promotions at any time

22.4 Non-Transferability Gift vouchers, packages, and promotional credits are non-transferable unless explicitly stated otherwise.


23. WEBSITE USE & ONLINE CONDUCT

23.1 Lawful Use You warrant that your access to and use of the Ocean Glide website is not unlawful or prohibited by any laws that apply to you. You agree not to use the website for any illegal purpose.

23.2 Prohibited Activities You agree not to:

  • Interfere with or disrupt the website or servers
  • Circumvent security features
  • Attempt unauthorized access to any systems or data
  • Transmit viruses, malware, or harmful code
  • Scrape, harvest, or collect data without permission
  • Use automated systems (bots, scrapers) without permission
  • Impersonate others or misrepresent your identity
  • Post or transmit defamatory, obscene, or illegal content

23.3 Third-Party Links The Ocean Glide website may contain links to third-party websites. These links are provided for convenience only. Ocean Glide:

  • Does not endorse third-party websites
  • Is not responsible for third-party content, products, or services
  • Is not liable for any loss or damage from use of third-party websites
  • Recommends you review third-party terms and privacy policies

23.4 Linking to Ocean Glide You must not:

  • Establish a link to Ocean Glide in a way suggesting association or endorsement where none exists
  • Link from a website not owned by you without permission
  • Frame the Ocean Glide website
  • Link to any page other than the homepage without permission

Ocean Glide reserves the right to withdraw linking permission at any time.

23.5 User Comments & Feedback By submitting comments, reviews, feedback, suggestions, or other content to Ocean Glide (via website, email, social media, or otherwise), you:

  • Grant Ocean Glide a perpetual, royalty-free license to use, reproduce, modify, and distribute such content
  • Warrant that you own the rights to the content submitted
  • Waive any moral rights in the content
  • Agree that Ocean Glide has no obligation to: maintain content in confidence, pay compensation, or respond

You agree that your comments will not:

  • Violate any third-party rights
  • Contain defamatory, obscene, or illegal content
  • Contain malware or viruses
  • Misrepresent your identity

Ocean Glide reserves the right to monitor, edit, or remove any content at its sole discretion.


24. COMPETITION & CONSUMER LAW

24.1 Australian Consumer Law Nothing in this Agreement excludes, restricts, or modifies rights or remedies conferred by the Competition and Consumer Act 2010 (Cth) or other national, state, or territory legislation that cannot lawfully be excluded, restricted, or modified (non-excludable rights).

24.2 Limitation Where Permitted To the maximum extent permitted by law, Ocean Glide's liability for breach of any non-excludable consumer guarantee is limited to, at Ocean Glide's option:

  • Re-supply of the services, or
  • Payment of the cost of having the services re-supplied

24.3 Goods vs Services Ocean Glide's Programs are primarily services. To the extent that any goods are supplied (e.g., equipment rental), the above limitation applies.


25. DISPUTE RESOLUTION & GOVERNING LAW

25.1 Governing Law This Agreement is governed by and must be construed according to the laws of Queensland, Australia.

25.2 Jurisdiction All disputes arising from or related to this Agreement or participation in Ocean Glide Programs shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia. You irrevocably submit to this jurisdiction.

25.3 Mediation Before commencing legal proceedings, the parties agree to attempt resolution through good-faith mediation. Each party will bear its own mediation costs.

25.4 Legal Costs If legal proceedings are commenced, the prevailing party shall be entitled to recover reasonable legal costs and expenses from the other party.


26. GENERAL PROVISIONS

26.1 Amendments Ocean Glide reserves the right to modify, amend, or update these Terms & Conditions at any time without prior notice. Amendments will be effective immediately upon posting on the website with an updated "Last Updated" date.

Continued use of the website or participation in Programs after amendments constitutes acceptance of the modified Terms.

For bookings made before amendments, the Terms in effect at the time of booking will apply unless the amendments relate to safety or legal compliance.

26.2 No Warranties To the maximum extent permitted by law, Ocean Glide provides all services "as is" and makes no warranties or representations of any kind, express or implied, including but not limited to:

  • Warranties of quality, fitness for purpose, or merchantability
  • That weather or ocean conditions will be favorable
  • That wildlife encounters will occur
  • That equipment will be defect-free
  • That the website will be error-free or uninterrupted
  • That information on the website is accurate or complete

26.3 Severability If any provision of this Agreement is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision will be severed, and the remaining provisions will continue in full force and effect.

26.4 Waiver Failure or delay by Ocean Glide to exercise any right or power under this Agreement does not operate as a waiver of that right or power. A waiver of any breach does not constitute a waiver of any subsequent breach.

Any waiver must be in writing and signed by an authorized representative of Ocean Glide to be effective.

26.5 Entire Agreement This Agreement (these Terms & Conditions together with the Privacy Policy and any Program-specific terms) constitutes the entire agreement between you and Ocean Glide regarding the subject matter herein and supersedes all prior:

  • Agreements
  • Understandings
  • Representations
  • Discussions
  • Proposals

No verbal or written representations outside this Agreement are binding.

26.6 Assignment You may not assign, transfer, or delegate your rights or obligations under this Agreement without Ocean Glide's prior written consent.

Ocean Glide may assign, transfer, or delegate its rights and obligations at any time without notice or consent.

26.7 Relationship of Parties Nothing in this Agreement creates a partnership, joint venture, employment, or agency relationship between you and Ocean Glide. You have no authority to bind Ocean Glide or make commitments on Ocean Glide's behalf.

26.8 Survival Provisions of this Agreement that by their nature should survive termination will survive, including but not limited to:

  • Liability waivers and releases
  • Indemnification obligations
  • Intellectual property provisions
  • Dispute resolution
  • Governing law

26.9 Interpretation In this Agreement:

  • Singular includes plural and vice versa
  • Reference to any gender includes all genders
  • Headings are for reference only
  • "Including" means "including without limitation"
  • Reference to any statute includes amendments and replacements
  • Reference to persons includes bodies corporate and incorporated and vice versa

26.10 Notices All notices required or permitted under this Agreement must be:

  • In writing
  • Sent to cindy@oceanglide.co (for notices to Ocean Glide)
  • Sent to the email address provided in your Registration Data (for notices to you)

Notices are deemed received:

  • If by email: 24 hours after sending (unless delivery failure notice received)
  • If by mail: 3 business days after posting

26.11 Typographical Errors To the maximum extent permitted by law, all typographical, clerical, or other errors or omissions in information issued by Ocean Glide (including pricing, dates, locations, descriptions) will be subject to correction without liability.

Ocean Glide reserves the right to cancel bookings made on the basis of erroneous information and provide full refunds.


27. ACKNOWLEDGEMENT & ACCEPTANCE

BY BOOKING, PURCHASING, OR PARTICIPATING IN ANY OCEAN GLIDE SERVICE, PRODUCT, OR PROGRAM, YOU CONFIRM THAT YOU HAVE:

✓ Read these Terms & Conditions in full and understand them completely ✓ Had reasonable opportunity to seek independent legal advice ✓ Understood the inherent risks of ocean activities including risk of death or serious injury ✓ Voluntarily chosen to participate knowing these risks ✓ Agreed to release Ocean Glide and Cindy Yang from all liability ✓ Agreed to indemnify Ocean Glide and Cindy Yang for claims arising from your participation ✓ Provided complete and accurate medical information ✓ Met all prerequisites for your chosen Program ✓ Agreed to follow all safety instructions and conduct requirements ✓ Accepted all cancellation policies and terms ✓ Acknowledged that Ocean Glide is a sole trader business operated by Cindy Yang ✓ Acknowledged that independent contractors are not employees of Ocean Glide ✓ Understood and accepted the maximum liability cap ✓ Agreed to the governing law and jurisdiction of Queensland, Australia
