COMPREHENSIVE TERMS & CONDITIONS

IMPORTANT: THIS IS A LEGALLY BINDING CONTRACT. BY BOOKING, PURCHASING, OR PARTICIPATING IN ANY OCEAN GLIDE SERVICE, PRODUCT, OR PROGRAM, YOU CONFIRM THAT YOU HAVE READ AND AGREE TO ALL TERMS CONTAINED IN THIS DOCUMENT.

These Terms & Conditions have been drafted to comply with the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law. Nothing in this document removes or limits your rights under the Australian Consumer Law. Where any term conflicts with a non-excludable statutory right, the statutory right prevails.


  1. AGREEMENT & OPERATOR

1.1 Business Entity Ocean Glide is a sole trader business operated by Cindy Yang, ABN 57 581 771 727 ("the Operator", "Ocean Glide", "we", "our" or "us").

1.2 Agreement These Terms and Conditions, together with our Privacy Policy (available at oceanglide.co/privacy), apply to your use of Ocean Glide's website and all Services (collectively, the "Agreement").

1.3 Acceptance By browsing the website, placing an order, making a booking, or participating in any Service, you agree to be bound by this Agreement. If you do not agree, you must not access, browse, use, book, or participate in any Ocean Glide Service.

1.4 Scope of Services These Terms & Conditions apply to all Ocean Glide offerings, both domestic and international, including:

Expeditions & Multi-Day Programs (International & Domestic):

  • International surf, freediving, and spearfishing expeditions
  • Liveaboard experiences
  • Island-based retreats and immersive programs
  • Multi-day training intensives

Local Courses & Workshops (Gold Coast & Australia):

  • Freediving courses and certification programs
  • Spearfishing skills courses
  • Surf coaching and technique workshops
  • Breathwork and BluePrint™ training sessions
  • Ocean safety and first aid courses
  • Single-day and half-day workshops
  • Beach-based training sessions
  • Pool-based skills development

Private Services:

  • One-on-one coaching (surf, freediving, breathwork)
  • Small group private sessions
  • Video analysis and performance consulting
  • Online coaching and programming

Products & Digital Content:

  • Ocean Glide wetsuit lube and related merchandise
  • Online courses and digital programs
  • Educational materials and training manuals

1.5 Third-Party Contractors Ocean Glide may engage independent contractors, guest facilitators, co-hosts, boat operators, accommodation providers, pool facility operators, and other third-party service providers to deliver Programs.

IMPORTANT: By participating, you acknowledge and expressly agree that these third parties are not employees, agents, or representatives of Ocean Glide or Cindy Yang. Ocean Glide has no control over the actions of independent contractors. You release Ocean Glide and Cindy Yang from any liability arising from the actions, negligence, or omissions of such third parties. Your sole recourse for issues with third-party services is against those third parties directly.

1.6 Co-Hosted Programs Some Programs may be co-hosted with partner organisations. In such cases, the terms and conditions of all operators apply. Ocean Glide and Cindy Yang are not liable for the actions of co-hosts or their employees or contractors.


  1. DEFINITIONS

In this Agreement, the following terms have the meanings set out below. Singular includes plural and vice versa.

"Agreement" means these Terms and Conditions together with the Privacy Policy.

"Course" means freediving, spearfishing, or surf courses and certification programs run by Ocean Glide.

"Expedition" means multi-day international or domestic freediving, spearfishing, or surf trips.

"Force Majeure Event" has the meaning given in Section 16.1.

"Guest" means a person who has registered for an Expedition or Trip.

"Instructor" means Ocean Glide staff or independent contractors delivering instruction.

"Intellectual Property Rights" means all present and future intellectual or industrial property rights throughout the world.

"Non-Recoverable Third-Party Costs" means amounts paid by Ocean Glide to third-party suppliers on a participant's behalf that cannot be recovered by Ocean Glide following cancellation, as documented in a Supplier Cost Statement.

"Privacy Policy" means Ocean Glide's privacy policy available at oceanglide.co/privacy.

"Program" or "Service" means any Ocean Glide offering including Courses, Training, Workshops, Expeditions, Trips, coaching, or products.

"Registration Data" means information provided by you for registration purposes.

"Student" means a person who has registered for a Course, Workshop, or Training.

"Supplier Cost Statement" means the written statement provided by Ocean Glide itemising Non-Recoverable Third-Party Costs as described in Section 16.6.

"Training" means freediving, spearfishing, or surf training including pool, open water, and beach-based sessions.

"Trip" means local Australia-based multi-day or single-day ocean experiences.

"Workshop" means single-session or short-duration skills training.


  1. BOOKING & CONFIRMATION

3.1 Age Requirement All Students and Guests must be 18 years of age or over unless otherwise specified. Ocean Glide reserves the right to request proof of age.

3.2 Booking Confirmation A booking is confirmed only when all of the following conditions are met:

  • An order has been placed via the website or accepted in writing
  • The required deposit or full payment has been received and cleared into Ocean Glide's account
  • These Terms & Conditions have been accepted
  • Any required application or interview process has been completed where applicable
  • Ocean Glide has sent written confirmation by email that the booking is confirmed

3.3 Program Confirmation for International Expeditions For international expeditions, Ocean Glide will send a separate Program Confirmation email no later than 8 weeks before departure confirming that the Program is proceeding as planned. This is distinct from your Booking Confirmation. If you have not received a Program Confirmation by 8 weeks before departure, contact Ocean Glide immediately at cindy@oceanglide.co.

Note: Ocean Glide strongly recommends that participants do not book non-refundable flights or independent accommodation until the Program Confirmation has been received.

3.4 Participant Acknowledgement By submitting payment, you confirm and warrant that:

  • You have read, understood, and agree to these Terms in full
  • You meet the minimum participation requirements for the specific Program
  • You voluntarily accept all risks associated with ocean-based activities
  • All information provided is true, accurate, and complete
  • You have disclosed all relevant medical conditions
  • You are physically and mentally capable of participating safely

3.5 Right to Refuse Service Ocean Glide reserves the right to refuse or cancel any booking at any time at our sole discretion, including for safety concerns, failure to meet prerequisites, incomplete information, or insufficient enrollment numbers. Where Ocean Glide refuses or cancels a booking, a full refund of payments made will be issued.

3.6 Instructor Discretion Instructors and guides reserve the absolute right to refuse to deliver part or all of a Service to any Guest or Student for safety, wellbeing, behavioral, or capability reasons. No refund will be provided in such circumstances.

3.7 Prerequisites It is the sole responsibility of Students and Guests to ensure that required prerequisites are met before attending any Service. Failure to meet prerequisites will result in refusal of service without refund.


  1. PAYMENT & PRICING

4.1 Currency All prices are listed in Australian Dollars (AUD) or United States Dollars (USD) as specified for each Program and include GST where applicable for Australian Programs.

4.2 Pricing Changes

  • All prices are subject to change without notice
  • Prices for confirmed bookings are fixed once confirmation is sent
  • Ocean Glide reserves the right to adjust pricing due to currency fluctuations, fuel surcharges, government-imposed taxes, or significant changes in operational costs
  • Participants will be notified of any changes before final payment is due

4.3 Deposits — Nature and Purpose All deposits represent a direct contribution toward third-party supplier costs committed by Ocean Glide on your behalf at the time of booking confirmation. These costs include but are not limited to liveaboard charter commitments, accommodation deposits, marine park permits, local operator fees, and facility bonds. These costs are committed immediately upon booking confirmation and may not be recoverable from third-party suppliers in the event of cancellation.

In all cancellation scenarios — whether participant-initiated or operator-initiated including Force Majeure Events — Ocean Glide will provide you with a written Supplier Cost Statement within 14 days of the cancellation event, itemising all third-party costs committed on your behalf that are confirmed non-recoverable.

The deposit amount applied against Non-Recoverable Third-Party Costs is capped at the actual documented costs incurred. If total Non-Recoverable Third-Party Costs are less than the deposit paid, Ocean Glide will refund the difference. If Non-Recoverable Third-Party Costs exceed the deposit paid, Ocean Glide absorbs the excess and will not seek recovery from you.

4.4 Deposit Non-Refundability Deposits are non-refundable in participant-initiated cancellations, subject to Clause 4.3 above. In operator-initiated cancellations including Force Majeure Events, deposits are handled as specified in Section 16.

Nothing in this clause removes or limits your rights under the Australian Consumer Law.

4.5 Deposit Requirements

International Expeditions:

  • A non-refundable deposit as specified in the Program details is required to secure your place
  • If booking is made less than 13 weeks prior to departure, full payment is required

Local Multi-Day Programs:

  • A non-refundable deposit as specified is required
  • If booking is made less than 4 weeks prior to start date, full payment may be required

Courses:

  • A deposit as specified is required to secure your place
  • Remaining balance due as specified in booking confirmation

Single-Session Workshops and Training:

  • Full payment required at time of booking

4.6 Balance Payment The remaining balance must be paid by the date specified in your booking confirmation:

  • International Expeditions: 13 weeks (3 months) prior to departure date unless otherwise specified
  • Local Programs: 4 weeks prior to start date unless otherwise specified
  • Courses: As specified in booking confirmation

Failure to pay the balance by the due date may result in automatic cancellation of your booking, forfeiture of deposits paid, and loss of place on the Program.

4.7 Payment Methods

  • Deposits: Credit card, debit card, or bank transfer
  • Balance payments: Bank transfer only unless otherwise specified
  • Local workshops: Credit card, debit card, bank transfer, or cash
  • A surcharge may apply to credit card payments depending on the card type used

4.8 Payment Processing Payment processing is provided by Stripe and is subject to the Stripe Services Agreement. By using Stripe to process payments, you agree to be bound by the Stripe Services Agreement.

4.9 Currency Fluctuations In the event of any refund, Ocean Glide will refund the original amount invoiced in the original currency and is not responsible for currency fluctuations.


  1. CANCELLATIONS & REFUNDS

5.1 Cancellation Notification All cancellations must be submitted in writing to cindy@oceanglide.co and are effective from the date Ocean Glide receives written notification.

5.2 No Exceptions Policy Ocean Glide does not offer credit, refund, or compensation for:

  • Arriving late or departing early from any Program
  • Missing activities or opting out of activities
  • Not utilising any part of the Program
  • Medical issues arising after booking where no medical clearance requirement applies

5.3 Participant-Initiated Cancellations

International Expeditions:

  • Deposit: Non-refundable under all circumstances, subject to Section 4.3
  • 6+ months (26+ weeks) before departure: Payments beyond deposit may be refunded in full, OR applied to another Expedition within 12 months at Guest's election
  • 3 to 6 months (13 to 26 weeks) before departure: 50% of total payment excluding deposit forfeited; 50% may be refunded OR applied to another Expedition within 12 months at Guest's election
  • Less than 3 months (13 weeks) before departure: 100% of total payment forfeited; no refund or transfer available
  • No-shows, late arrivals, early departures: No refund or credit issued

Local Multi-Day Trips (Australia):

  • 4+ weeks before start date: Full refund less non-refundable deposit
  • Less than 4 weeks before start date: No refund or transfer available
  • No-shows, late arrivals, early departures: No refund or credit issued

Courses:

  • 7+ days before start date: 100% payment refunded
  • 0 to 7 days before start date: $200 AUD reschedule fee applies; no refund available
  • During course — missed sessions or opt-outs: No refund available
  • Failure to complete course within 12 months: Student must complete course again at full price

Single-Session Workshops & Training:

  • 48+ hours before session: 100% payment refunded or transferred
  • Less than 48 hours before session: No refund or transfer available
  • No-shows or late arrivals: No refund available

Private Group Bookings:

  • Treated as single booking with one designated point of contact (POC)
  • POC is responsible for all payments and group changes
  • If a group member drops out, the POC must refill the spot or forfeit the cost for that place
  • No refunds or discounts for reduced group size

5.4 Medical Cancellations If a Student or Guest fails to provide required medical clearance by the specified deadline, this will be treated as a participant-initiated cancellation effective from the date Ocean Glide was notified of the failure. Standard cancellation fees apply.

5.5 Failure to Meet Physical Prerequisites If a Student cannot demonstrate required physical prerequisites on the day of the Program, no refund will be granted. This constitutes a participant-initiated cancellation on the day.

5.6 Operator-Initiated Cancellations Ocean Glide reserves the right to modify, reschedule, postpone, or cancel any Program due to:

  • Weather or ocean conditions deemed unsafe by instructors or crew
  • Vessel safety or mechanical issues
  • Pool or facility unavailability
  • Insufficient enrollment numbers
  • Medical emergencies affecting delivery
  • Instructor illness or unavailability
  • Government restrictions, border closures, or travel advisories
  • Force Majeure Events as defined in Section 16
  • Failure or insolvency of third-party service providers
  • Changes to regulations or legislation

If Ocean Glide cancels a Program prior to start date, Guests or Students may elect:

  • Full refund of all payments made, excluding documented Non-Recoverable Third-Party Costs as per the Supplier Cost Statement, OR
  • Credit toward a future Ocean Glide Program to be used within 12 months, OR
  • Transfer to an alternative date subject to availability

5.7 What Ocean Glide is Not Responsible For Ocean Glide and Cindy Yang are not responsible for and will not reimburse:

  • International or domestic flights booked independently
  • Accommodation booked independently before, during, or after the Program
  • Travel insurance premiums
  • Visa application fees
  • Airport transfers not included in the Program
  • Meals not included in the Program
  • Lost wages or opportunity costs
  • Non-refundable bookings made independently in conjunction with the Program
  • Currency exchange fees or fluctuations
  • Expenses incurred in preparation for cancelled Services

Note: Ocean Glide strongly recommends that participants do not book non-refundable flights or independent accommodation until the Program Confirmation has been received (see Section 3.3). Comprehensive travel insurance covering trip cancellation should be purchased at the time of deposit payment.

5.8 Itinerary & Schedule Changes Ocean Glide reserves the right to make reasonable changes to itineraries, schedules, locations, activities, dive sites, accommodation (provided standards are maintained), instructors, guides, dates, and times. Reasonable changes do not constitute grounds for refund or compensation.


  1. BOOKING REQUIREMENTS

6.1 Mandatory Documentation To book any Service, every Student or Guest must provide:

  • Completed medical questionnaire or doctor's clearance where required
  • Signed participation and liability waiver
  • Evidence of compliance with current government health requirements if applicable
  • Complete and accurate registration information including emergency contacts
  • Proof of comprehensive travel insurance for all international Programs

6.2 Deadlines for Documentation

  • International Expeditions: 4 weeks prior to departure
  • Local Programs: 1 week prior to start date
  • Courses: Before first session
  • Workshops: Before session or with notification if medical clearance is required

6.3 Failure to Provide Documentation Failure to provide required documentation by the specified deadline will be treated as a participant-initiated cancellation. All payments made will be forfeited and no refund or credit will be issued.


  1. EQUIPMENT

7.1 Equipment Provided by Ocean Glide Where Ocean Glide provides equipment, Students and Guests are responsible for using it correctly, inspecting it before use, caring for it during use, returning it in good condition, and reporting damage or malfunction immediately.

7.2 Equipment Damage, Loss, or Non-Return Damaged, lost, or unreturned equipment will be charged at full replacement value plus administrative fees. Students and Guests are liable for negligent damage, lost equipment, stolen equipment (unless reported to police and Ocean Glide within 24 hours), and equipment not returned. Normal wear and tear is accepted.

7.3 Personal Equipment Ocean Glide is not responsible for damage, loss, or theft of personal equipment brought to any Program.


  1. TRAVEL INSURANCE

8.1 Mandatory for International Programs Comprehensive travel insurance is MANDATORY for all international Expeditions and multi-day Programs. Insurance must include coverage for:

  • Ocean activities including surfing, freediving, spearfishing, diving, and snorkeling
  • Medical treatment and hospitalisation
  • Emergency evacuation and repatriation
  • Trip cancellation and interruption
  • Lost or damaged personal belongings
  • Trip cancellation due to Force Majeure Events where available

Note: Standard travel insurance policies frequently exclude cancellation due to war, conflict, natural disaster, and airline insolvency. You should verify your specific coverage before booking. Purchasing insurance at the time of deposit payment is strongly recommended so that events occurring between booking and departure may be covered. Confirm with your insurer that freediving, spearfishing, and all Program activities are covered under your specific policy.

8.2 Recommended for All Programs While not mandatory for local courses and workshops, Ocean Glide strongly recommends comprehensive activity insurance covering ocean-based activities for all Programs.

8.3 Proof of Insurance

  • Proof of valid travel insurance must be provided upon request
  • For international Programs, proof must be submitted at least 4 weeks prior to departure
  • Failure to provide proof of insurance may result in cancellation without refund

8.4 Participant Responsibility It is the Participant's sole responsibility to obtain appropriate insurance, ensure the policy covers all Program activities, understand all policy terms and exclusions, file claims directly with the insurance provider, and provide accurate information to the insurer. Ocean Glide accepts no liability for inadequate, inappropriate, or absent insurance coverage.


  1. HEALTH, FITNESS & MEDICAL DISCLOSURE

9.1 Fitness Requirements By participating, you confirm and warrant that you are physically and mentally fit for ocean-based activities, capable of meeting the physical demands of your chosen Program, free from medical conditions that would prevent safe participation, not under the influence of drugs or alcohol, and have honestly disclosed all relevant medical information.

9.2 Mandatory Medical Disclosure You must disclose all relevant medical conditions, medications, allergies, and health concerns, including but not limited to:

  • Cardiovascular or heart conditions
  • Respiratory issues including asthma and COPD
  • Ear, sinus, or lung problems or surgeries
  • Neurological conditions or seizure disorders
  • Diabetes or blood sugar issues
  • Pregnancy or possibility of pregnancy
  • Psychological or psychiatric conditions
  • Current medications
  • Recent surgeries or injuries
  • Allergies including to marine life

9.3 Consequences of Non-Disclosure Failure to disclose relevant medical information may result in immediate removal from the Program without refund, voiding of all liability waivers, personal liability for all medical and evacuation costs, and potential legal liability for endangering others.

9.4 Medical Clearance Requirements Doctor's clearance is required for conditions including but not limited to cardiovascular disease, respiratory issues, ear or lung surgeries within 12 months, seizure disorders, pregnancy, diabetes, psychological conditions affecting safety, and any condition requiring hospitalisation in the past 12 months. Clearance must be on official letterhead, signed and dated within 3 months of Program start, and specifically state fitness for the applicable activities.

9.5 Pregnancy Pregnant participants cannot participate in any ocean-based Programs. If you become pregnant after booking, you must notify Ocean Glide immediately. Standard cancellation terms apply. Travel insurance may cover this circumstance.

9.6 Substance Use Participation under the influence of alcohol or illegal drugs is strictly prohibited. Violations will result in immediate removal from the Program without refund. Ocean Glide may report illegal drug use to authorities.

9.7 Changes in Health Status If your health status changes between booking and the Program start date, you must notify Ocean Glide immediately in writing, provide updated medical information, and obtain new medical clearance if required.

9.8 Daily Health Declarations For multi-day Programs, participants may be required to complete daily health declarations confirming fitness to participate. False declarations may result in removal without refund.


  1. OCEAN RISK ACKNOWLEDGEMENT

10.1 Inherent and Significant Risks You acknowledge, understand, and expressly agree that ocean-based activities involve inherent, significant, and potentially life-threatening risks including but not limited to:

Water-Related Risks:

  • Drowning or near-drowning
  • Shallow water blackout
  • Hypoxia and oxygen deprivation
  • Decompression sickness
  • Barotrauma including lung squeeze and ear squeeze
  • Air embolism

Environmental Risks:

  • Strong currents, rip tides, and changing ocean conditions
  • Reef contact, cuts, and lacerations
  • Boat traffic and propeller strikes
  • Extreme weather, lightning, hypothermia, and hyperthermia

Marine Life Risks:

  • Sharks, rays, and other potentially dangerous marine animals
  • Jellyfish, sea snakes, venomous fish, and stinging creatures
  • Coral cuts and marine infections

Equipment & Activity Risks:

  • Equipment failure or malfunction
  • Speargun injuries and entanglement
  • Surfboard impact and boat-related injuries

Location Risks:

  • Remote locations with limited medical access
  • Delayed emergency response and evacuation difficulties
  • Distance from hyperbaric chambers
  • Language barriers in international locations

10.2 Risk of Death or Permanent Injury You specifically acknowledge that ocean activities can result in death, permanent disability, paralysis, brain damage, loss of limbs, blindness, hearing loss, chronic pain, scarring, and psychological trauma.

10.3 Voluntary Assumption of All Risks You voluntarily and expressly assume ALL risks associated with participation. You acknowledge that Ocean Glide and its instructors cannot guarantee your safety, that accidents can occur even with proper safety procedures, and that you are choosing to participate knowing these risks.

10.4 Personal Responsibility for Safety You accept full personal responsibility for your safety and agree to follow all safety briefings and instructions, make conservative decisions based on your personal skill level, communicate concerns immediately and honestly, withdraw from activities if you feel unsafe, and never participate under the influence of alcohol or drugs.

10.5 No Rescue Guarantee Ocean Glide and its instructors will make reasonable efforts to assist in emergencies. However, rescue is not guaranteed. Conditions may prevent or delay rescue. Emergency services may be unavailable, delayed, or distant. You may be required to self-rescue.


  1. SAFETY & CONDUCT

11.1 Mandatory Safety Protocols Participants must attend all safety briefings, follow all instructions from Ocean Glide staff and contractors immediately and completely, use all provided safety equipment correctly, perform required safety checks before all activities, and report all incidents, near-misses, and safety concerns without delay.

11.2 Conduct Requirements Participants must respect instructors, crew, guides, and fellow participants; respect local cultures, customs, and laws; arrive on time for all sessions and activities; and not create unnecessary risk for themselves or others.

11.3 Prohibited Behaviors The following behaviors will result in immediate removal from the Program without refund:

  • Unsafe behavior in or around water
  • Ignoring or refusing to follow safety instructions
  • Disruptive, aggressive, threatening, or disrespectful conduct
  • Harassment of any kind
  • Being under the influence of alcohol or drugs during activities
  • Illegal drug use at any time
  • Environmental negligence or deliberate harm to marine life
  • Theft or damage to property
  • Violating local laws or regulations
  • Reckless endangerment of self or others

11.4 Instructor Absolute Discretion Instructors and guides have absolute discretion to refuse participation in any activity for any safety, behavioral, or wellbeing reason, end a session immediately, remove a participant from activities or the entire Program, and modify activities based on conditions or participant capability. No refund, credit, or compensation will be provided when participants are removed or refused for safety, behavioral, or wellbeing reasons.


  1. ENVIRONMENTAL & ETHICAL RESPONSIBILITY

12.1 Environmental Commitment All participants agree to respect marine life and reef environments, follow ethical wildlife interaction guidelines, minimise environmental impact, leave no trace, never touch or harass marine life, use only reef-safe and biodegradable products, respect protected marine areas, and follow all environmental regulations.

12.2 Ethical Wildlife Interactions Wildlife encounters are a privilege, not a right. All interactions must be on the animals' terms. Instructors may end encounters at any time if animal welfare is compromised. Maintain appropriate distances as instructed and leave immediately if animals show signs of stress.

12.3 Ethical Hunting — Spearfishing Programs For spearfishing Programs, participants agree to practice selective and sustainable hunting only, take only what will be consumed, make clean and humane shots, follow all size and bag limits strictly, avoid protected or threatened species, respect spawning aggregations, and follow all local fishing regulations.

12.4 Zero Tolerance Policy Ocean Glide has zero tolerance for deliberate harm to marine life, taking protected species, exceeding bag limits, unethical hunting practices, environmental damage, littering, or violation of marine protected areas. Violations will result in immediate removal from the Program without refund and may be reported to authorities.

12.5 Photography Ethics Animal welfare always takes priority over photos. Never harass animals for better photos. Respect requests not to share specific locations publicly to avoid site damage from overuse.


  1. LIABILITY WAIVER & RELEASE

13.1 Complete Release of Liability To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue Ocean Glide, Cindy Yang personally and in her capacity as sole trader, all independent contractors, co-hosts, facilitators, and instructors, boat operators, captains, crew, and vessel owners, accommodation providers, pool and facility operators, equipment manufacturers and suppliers, partner organisations, and all officers, agents, employees, volunteers, and representatives of the above (collectively, the "Released Parties") from any and all liability, claims, demands, actions, damages, losses, costs, and expenses for any injury, illness, death, loss, damage, or expense arising from participation in any Ocean Glide Program.

13.2 Scope of Release — Includes Negligence This release applies to claims arising from negligence of Ocean Glide, Cindy Yang, contractors, or third parties to the fullest extent permitted by law; negligence of other participants; equipment failure or malfunction; inherent risks of ocean activities; medical emergencies or delayed medical care; acts of nature or Force Majeure Events; and any other cause related to participation in the Program.

13.3 Broad Interpretation This release is intended to be as broad and inclusive as permitted by law. If any portion is held invalid, the remainder shall continue in full force and effect.

13.4 Binding on Heirs and Estate You acknowledge that this release is binding on your heirs, next of kin, executors, administrators, assigns, and legal representatives.

13.5 Waiver of Rights You expressly waive any rights under any statute or law that would limit the scope of this release to the extent permitted by law, including but not limited to the Civil Liability Act 2002 (NSW) and similar legislation in other Australian states and territories.


  1. INDEMNIFICATION

14.1 Your Agreement to Indemnify You agree to indemnify, defend, and hold harmless Ocean Glide, Cindy Yang, and all Released Parties from any and all claims, damages, losses, liabilities, and expenses including reasonable legal fees arising from or related to your actions, negligence, recklessness, or misconduct; your breach of these Terms; your violation of any laws or regulations; any injury or damage you cause to others or their property; any misrepresentation or failure to disclose medical information; claims brought by your family, heirs, or legal representatives; and rescue, medical, or evacuation costs incurred on your behalf.

14.2 Survival This indemnification survives the termination of your participation in any Program and continues indefinitely.


  1. MAXIMUM LIABILITY CAP

15.1 Aggregate Liability Limit Without limiting the liability release and indemnification provisions, and to the maximum extent permitted by law, Ocean Glide's and Cindy Yang's maximum aggregate liability for any and all claims arising from participation in any Program shall not exceed AUD $100,000.00 (one hundred thousand Australian dollars).

15.2 Fair Allocation of Risk You acknowledge that the limitations of liability in this Agreement represent a fair and reasonable allocation of commercial and legal risk between the parties, given the inherently dangerous nature of ocean activities, the sole trader structure of the business, the pricing of Programs, your voluntary assumption of risk, and the availability of personal insurance to you.

15.3 No Liability for Certain Damages To the maximum extent permitted by law, Ocean Glide excludes all liability for special, indirect, or consequential loss or damage; loss of income, revenue, business, or profits; loss of data or privacy; loss of goodwill or reputation; and any damages exceeding the liability cap in Clause 15.1.


  1. FORCE MAJEURE

16.1 Definition of Force Majeure Events A "Force Majeure Event" means an event or circumstance beyond the reasonable control of Ocean Glide that makes it impossible, illegal, or genuinely unsafe to deliver the Program as booked, including but not limited to:

  • Natural disasters including cyclones, earthquakes, tsunamis, floods, bushfires, and volcanic activity
  • Pandemic or epidemic declared by the World Health Organization or Australian Government
  • Government-imposed travel bans, border closures, or mandatory quarantine requirements affecting the Program destination or departure point
  • War, invasion, terrorism, hostilities (whether war is declared or not), civil unrest, or riots at or materially affecting the Program destination
  • Airspace closures or suspension of airline routes to the Program destination
  • Fuel shortages causing suspension of essential transport services to the Program destination
  • Closure of ports or waterways essential to Program delivery
  • Mechanical failure of the primary Program vessel with no viable alternative available
  • Insolvency of a primary third-party supplier where no comparable alternative can be secured
  • Changes to regulations or legislation making Program delivery illegal
  • Cyber attacks or critical technology failures affecting Program infrastructure

16.2 What Does Not Constitute a Force Majeure Event The following do not constitute Force Majeure Events under this Agreement:

  • Poor weather or ocean conditions that are manageable with reasonable itinerary modification
  • Low enrollment numbers
  • Changes in personal circumstances of participants
  • General economic conditions or increases in fuel costs that do not cause suspension of services
  • Events that were reasonably foreseeable at the time of booking
  • Instructor or staff illness or unavailability (these are managed under Section 5.6)

16.3 Ocean Glide's Obligations When a Force Majeure Event Occurs Upon becoming aware of a Force Majeure Event that prevents Program delivery, Ocean Glide will:

  • Notify all affected participants in writing as soon as reasonably practicable, and in any case within 48 hours of becoming aware that the Program cannot proceed as planned
  • Provide participants with a written Supplier Cost Statement within 14 days of the cancellation event, itemising all Non-Recoverable Third-Party Costs
  • Make genuine and documented efforts to recover deposits and prepayments from all third-party suppliers, and pass any recovered amounts through to participants in full without deduction
  • Provide participants with a choice of remedy options as described in Section 16.4

16.4 Remedy Options — Participant's Choice Where a Program is cancelled due to a Force Majeure Event, each participant may elect one of the following remedy options:

Option A — Partial Refund: A refund of all payments made by the participant, less the actual confirmed Non-Recoverable Third-Party Costs as documented in the Supplier Cost Statement. Ocean Glide's own administration costs, facilitation fees, and internal margin are not deductible under this option and will be refunded in full regardless of the timing of the cancellation.

Option B — Full Credit: A credit equal to 100% of all payments made, applied to any future Ocean Glide Program of equal or greater value, valid for 24 months from the date of cancellation. No deduction for third-party costs is made under this option. The credit is transferable to one nominated person.

Option C — Rescheduled Departure: Transfer of the full booking to an alternative departure date for the same or a comparable Program, subject to availability. No deduction for third-party costs is made where the same suppliers can be retained for the rescheduled departure.

16.5 Tiered Deduction Structure — Option A The following structure determines the maximum Non-Recoverable Third-Party Cost deduction applicable under Option A, based on how close to departure the Force Majeure Event occurs. These are maximum caps — actual deductions are limited to documented costs only.

More Than 6 Months Before Departure: At this stage, third-party supplier commitments are typically limited to initial booking deposits only. Maximum deductible amount: the actual non-recoverable initial supplier deposit paid. Ocean Glide will refund all other payments in full.

3 to 6 Months Before Departure: Third-party supplier costs at this stage may include accommodation deposits, liveaboard balance deposits, and permit fees. Maximum deductible amount: actual documented non-recoverable costs as evidenced in the Supplier Cost Statement. Ocean Glide will refund all payments made less documented costs.

Less Than 3 Months Before Departure: Full third-party supplier costs for the Program are typically committed at this stage including liveaboard balances, accommodation balances, permits, and local operator fees. Maximum deductible amount: actual documented non-recoverable costs as evidenced in the Supplier Cost Statement. Ocean Glide will refund all payments made less documented costs and provide full documentation supporting each deduction.

In all cases, Ocean Glide's own facilitation fees, internal administration, and margin are not deductible and will be refunded in full under Option A regardless of timing.

16.6 Supplier Cost Statement — Requirements The Supplier Cost Statement provided to participants must include:

  • The name and contact details of each third-party supplier
  • The amount paid to each supplier on the participant's behalf
  • Written confirmation from each supplier that the relevant amount is non-refundable (email confirmation is acceptable)
  • Evidence of any partial recovery obtained or pending from suppliers
  • The net non-recoverable amount per participant after apportioning shared costs across the group on a pro-rata basis

Ocean Glide will provide the Supplier Cost Statement within 14 days of the cancellation event. Participants may request independent verification of supplier costs.

16.7 Force Majeure Does Not Remove Australian Consumer Law Rights Nothing in this Section removes or limits any rights you have under the Australian Consumer Law, including the right to a remedy where a service cannot be delivered. If there is any inconsistency between any provision of this Section and your rights under the Australian Consumer Law, the Australian Consumer Law prevails.

16.8 No Liability for Consequential Losses Ocean Glide and Cindy Yang are not liable for any consequential losses arising from a Force Majeure Event, including independently booked international or domestic flights, accommodation arranged independently, travel insurance premiums, visa costs, airport transfers, or lost income.

Note: Participants are strongly advised to hold comprehensive travel insurance that specifically includes trip cancellation and interruption cover, and to verify that their policy covers Force Majeure events including conflict, natural disaster, airline suspension, and supplier insolvency. Insurance should be purchased at the time of deposit payment.


  1. PERSONAL BELONGINGS & EQUIPMENT

17.1 Personal Responsibility Ocean Glide and Cindy Yang are not responsible for loss, theft, damage, or destruction of personal belongings, dive gear, surf equipment, electronics, cash, credit cards, travel documents, vehicles, medication, or any other personal property.

17.2 Secure Storage Ocean Glide will make reasonable efforts to provide secure storage during sessions and multi-day Programs but accepts no liability for theft, loss, or damage. Participants are strongly advised to leave unnecessary valuables at home, use waterproof cases for electronics, label all personal equipment, and obtain appropriate insurance for valuable items.

17.3 Vehicle Security Items left in vehicles during Programs are left entirely at the participant's risk. Ocean Glide and Cindy Yang have no responsibility for theft from or damage to vehicles.


  1. PHOTOGRAPHY & MEDIA RELEASE

18.1 Permission to Capture Media Ocean Glide, its staff, contractors, and designated photographers may capture photographs, video footage, audio recordings, and other media during Programs.

18.2 Grant of Rights By participating in any Program, you grant Ocean Glide a perpetual, worldwide, royalty-free, irrevocable licence to use, reproduce, modify, publish, distribute, and display such media for promotional and marketing purposes, educational content, print and digital publications, portfolio purposes, and any other business purpose.

18.3 No Compensation You acknowledge that you will receive no compensation, payment, or royalties for the use of your image, likeness, voice, or media featuring you.

18.4 Opt-Out Procedure You may opt out of media use by providing written notice to cindy@oceanglide.co prior to the Program start date (International: 4 weeks prior; Local: 1 week prior), clearly stating your name, booking reference, and opt-out request. Opt-out does not apply to group photos where you are incidentally included or to photos taken for safety documentation.

18.5 Participant Photography Participants are welcome to take personal photos and videos during Programs for personal use only, subject to not interfering with Program activities, respecting other participants' privacy, following ethical wildlife photography guidelines, not selling or commercially exploiting images without written permission, and not tagging specific locations of sensitive wildlife sites.


  1. INTELLECTUAL PROPERTY

19.1 Ocean Glide Ownership Ocean Glide and Cindy Yang are the sole and exclusive owners of all Intellectual Property Rights in the Ocean Glide website and all content, BluePrint™ methodology and framework, all training systems and curricula, educational materials, videos, audio recordings, digital content, logos, trademarks, proprietary techniques, and course structures.

19.2 Limited Licence You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use educational materials provided during your Program for personal, non-commercial purposes only.

19.3 Prohibited Uses You may not reproduce, distribute, sell, or commercially exploit Ocean Glide materials; use Ocean Glide methodologies for commercial purposes including teaching others; record or distribute Program content without written permission; claim ownership of Ocean Glide intellectual property; or teach or resell Ocean Glide methodologies without formal certification and written licensing agreement.


  1. PRIVACY & DATA PROTECTION

20.1 Information Collection Ocean Glide collects and processes personal information including contact details, medical and health information, emergency contact information, payment information, photographs and videos, booking and participation history, and correspondence.

20.2 Use of Information Your information is used for Program administration and communication, safety and medical purposes including sharing with emergency services if necessary, improving Ocean Glide services, marketing communications with consent, legal compliance, and statistical analysis.

20.3 Third-Party Sharing Your information may be shared with independent contractors and service providers, payment processors, medical professionals in case of emergency, emergency services if required, authorities if required by law, and insurance providers with your consent.

20.4 Full Privacy Policy For complete details about how Ocean Glide collects, uses, stores, and protects your personal information, please refer to the Privacy Policy at oceanglide.co/privacy.


  1. MINORS (UNDER 18 YEARS)

21.1 Parental/Guardian Consent Required Participants under 18 may only participate if a parent or legal guardian signs these Terms and all medical and consent forms, provides written authorisation for medical treatment, and specific age requirements for the Program are met.

21.2 Supervision Requirements For local Programs, a parent or legal guardian must remain on-site during all sessions unless alternative arrangements are approved in writing by Ocean Glide. For international Programs, minors must be accompanied by a parent or legal guardian also enrolled in the Program.

21.3 Parent/Guardian Liability The parent or legal guardian assumes all liability and responsibility for the Minor's participation and agrees to the terms of the liability waiver and indemnification on behalf of the Minor.


  1. PROMOTIONS, GIFT VOUCHERS & DISCOUNTS

22.1 Gift Voucher Validity Gift vouchers are valid for 36 months from date of purchase. Services must be booked within the 36-month validity period. Expired vouchers have no value and will not be honoured. No extensions will be granted.

22.2 Package Offers All services in a package must be booked within 36 months of purchase. Packages cannot be split between multiple people unless specified. No refunds for unused portions of packages.

22.3 Promotional Discount Codes Promotional codes may be offered at Ocean Glide's sole discretion. Codes cannot be combined unless explicitly stated and cannot be applied retroactively to confirmed bookings. Ocean Glide reserves the right to cancel or modify promotions at any time.

22.4 Non-Transferability Gift vouchers, packages, and promotional credits are non-transferable unless explicitly stated otherwise.


  1. WEBSITE USE & ONLINE CONDUCT

23.1 Lawful Use You warrant that your access to and use of the Ocean Glide website is lawful. You agree not to use the website for any illegal purpose, interfere with or disrupt the website or servers, attempt unauthorized access to any systems or data, transmit viruses or harmful code, or scrape or harvest data without permission.

23.2 Third-Party Links The Ocean Glide website may contain links to third-party websites for convenience only. Ocean Glide does not endorse third-party websites and is not responsible for third-party content, products, or services.

23.3 User Comments & Feedback By submitting comments, reviews, or feedback to Ocean Glide, you grant Ocean Glide a perpetual, royalty-free licence to use, reproduce, modify, and distribute such content. You warrant that you own the rights to the content submitted and that it does not violate any third-party rights or contain defamatory, obscene, or illegal content.


  1. COMPETITION & CONSUMER LAW

24.1 Australian Consumer Law Nothing in this Agreement excludes, restricts, or modifies rights or remedies conferred by the Competition and Consumer Act 2010 (Cth) or other national, state, or territory legislation that cannot lawfully be excluded, restricted, or modified.

24.2 Limitation Where Permitted To the maximum extent permitted by law, Ocean Glide's liability for breach of any non-excludable consumer guarantee is limited, at Ocean Glide's option, to re-supply of the services or payment of the cost of having the services re-supplied.


  1. DISPUTE RESOLUTION & GOVERNING LAW

25.1 Governing Law This Agreement is governed by and must be construed according to the laws of Queensland, Australia.

25.2 Jurisdiction All disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

25.3 Mediation Before commencing legal proceedings, the parties agree to attempt resolution through good-faith mediation. Each party will bear its own mediation costs.

25.4 Legal Costs If legal proceedings are commenced, the prevailing party shall be entitled to recover reasonable legal costs and expenses from the other party.


  1. GENERAL PROVISIONS

26.1 Amendments Ocean Glide reserves the right to modify these Terms & Conditions at any time. Amendments will be effective immediately upon posting on the website. For bookings made before amendments, the Terms in effect at the time of booking will apply unless amendments relate to safety or legal compliance.

26.2 No Warranties To the maximum extent permitted by law, Ocean Glide provides all services "as is" and makes no warranties that weather or ocean conditions will be favourable, that wildlife encounters will occur, that equipment will be defect-free, or that the website will be error-free or uninterrupted.

26.3 Severability If any provision of this Agreement is held invalid or unenforceable, it will be modified to the minimum extent necessary or severed if modification is not possible. The remaining provisions will continue in full force and effect.

26.4 Waiver Failure or delay by Ocean Glide to exercise any right under this Agreement does not operate as a waiver. Any waiver must be in writing and signed by an authorised representative of Ocean Glide to be effective.

26.5 Entire Agreement This Agreement constitutes the entire agreement between you and Ocean Glide regarding the subject matter and supersedes all prior agreements, understandings, representations, and discussions. No verbal or written representations outside this Agreement are binding.

26.6 Assignment You may not assign, transfer, or delegate your rights or obligations under this Agreement without Ocean Glide's prior written consent. Ocean Glide may assign, transfer, or delegate its rights and obligations at any time.

26.7 Relationship of Parties Nothing in this Agreement creates a partnership, joint venture, employment, or agency relationship between you and Ocean Glide.

26.8 Survival The following provisions survive termination of participation: liability waivers and releases, indemnification obligations, intellectual property provisions, dispute resolution, and governing law.

26.9 Notices All notices must be in writing and sent to cindy@oceanglide.co for notices to Ocean Glide, or to the email address provided in your Registration Data for notices to you. Notices sent by email are deemed received 24 hours after sending unless a delivery failure notice is received.

26.10 Typographical Errors All typographical, clerical, or other errors in information issued by Ocean Glide are subject to correction without liability. Ocean Glide reserves the right to cancel bookings made on the basis of erroneous information and provide full refunds.


  1. ACKNOWLEDGEMENT & ACCEPTANCE

THIS IS A LEGALLY BINDING CONTRACT. IF YOU DO NOT AGREE TO ALL TERMS, DO NOT BOOK OR PARTICIPATE.

BY BOOKING, PURCHASING, OR PARTICIPATING IN ANY OCEAN GLIDE SERVICE, PRODUCT, OR PROGRAM, YOU CONFIRM THAT YOU HAVE:

  • Read these Terms & Conditions in full and understand them completely
  • Had reasonable opportunity to seek independent legal advice
  • Understood the inherent risks of ocean activities including risk of death or serious injury
  • Voluntarily chosen to participate knowing these risks
  • Agreed to release Ocean Glide and Cindy Yang from all liability to the fullest extent permitted by law
  • Agreed to indemnify Ocean Glide and Cindy Yang for claims arising from your participation
  • Provided complete and accurate medical information
  • Met all prerequisites for your chosen Program
  • Agreed to follow all safety instructions and conduct requirements
  • Accepted all cancellation, refund, and force majeure policies
  • Understood that Ocean Glide is a sole trader business operated by Cindy Yang
  • Understood that independent contractors are not employees of Ocean Glide
  • Accepted the maximum liability cap set out in Section 15
  • Agreed to the governing law and jurisdiction of Queensland, Australia
  • Understood that your rights under the Australian Consumer Law are preserved and not removed by these Terms
